Terms of Service

These Terms of Service ("Terms") form the agreement between you and Edapt ("Edapt", "we", "us"). By using edaptlearn.com you agree to them. If you don't agree, please don't use Edapt.
1. Acceptance
Creating an account, signing in, or using Edapt means you accept these Terms and our Privacy Policy. If you're under 18, you confirm a parent or guardian agrees on your behalf.
2. What Edapt is
Edapt is a personal AI study tool. It turns any topic into lessons adapted to your VARK learning style and curriculum, and includes study tools such as study packs (flashcards, match, timed tests and memory aids), practice questions, mock exams, AI grading and feedback, an AI tutor chat ("Otto"), diagrams, audio overviews, cheat sheets, a step-by-step problem solver, multiplayer study sprints and battles, leaderboards, friends and avatars, a coin shop, and an exam planner. There is also a separate Kids mode for younger learners, set up and supervised by a parent through their account. Edapt is not a school, not a qualification provider, and not a replacement for a teacher.
3. Your account
You're responsible for keeping your password safe and for everything that happens under your account. You must give us accurate information and keep it up to date. When you sign up with an email address and password, you must confirm the address by entering the verification code we email you before you can sign in; signing in with Google confirms your address through Google instead. One person, one account. If you set up Kids mode, you may create and manage child profiles under your own account for children in your care; you're responsible for those profiles and for supervising how your child uses Edapt.
4. Acceptable use
You won't:
- Use Edapt to cheat in any assessment that prohibits AI assistance.
- Try to bypass usage limits or impersonate another user.
- Reverse-engineer, scrape, or otherwise misuse the service or APIs.
- Upload content you don't have the right to use, or anything illegal, hateful, sexually explicit involving minors, or that promotes self-harm.
- Use Edapt to generate content that violates someone else's privacy or intellectual property.
We may suspend or remove accounts that breach these rules.
5. AI output
Edapt uses large language models to generate lessons. AI can be wrong, biased, outdated, or miss your specific syllabus dot point. Always verify important answers against your textbook, teacher, or official syllabus. Edapt is a study aid, not a source of truth.
You own the lessons we generate for you for personal study. Don't resell or redistribute them as your own commercial product.
6. Your content
You keep ownership of anything you upload (PDFs, photos, voice memos, reflections, topics). You grant Edapt a limited licence to process that content to deliver the service to you. We don't train our own AI models on your content. Content is processed by third-party AI providers to generate your lessons, and one free-tier provider may use inputs to improve its models, see the AI model training section of our Privacy Policy for the specifics.
7. Subscriptions and billing
- There is a Free plan that needs no credit card, and two paid plans, Plus and Max. Current prices and the monthly allowances for each are set out on our pricing page, which forms part of these Terms.
- Free includes monthly allowances of AI lessons, study packs, printable cheatsheets, audio overviews and flashcard quizzes, photo and voice input, and unlimited flashcard decks and saved lessons. AI diagrams and the Exam Hall are only on the paid plans, and AI marking of submissions is only on Max. Each paid plan is a set of higher monthly allowances; the current numbers are on the pricing page.
- Paid allowances reset on the 1st of each month and do not roll over. Upgrading applies the new plan's allowances immediately.
- Where a feature is described as "unlimited" (for example flashcard decks), that means no monthly cap on it. A fair use policy applies across all plans to prevent automated use and account sharing.
- Prices are in Australian dollars and include GST. Paid plans renew automatically, monthly or annually, until cancelled. You may cancel at any time and keep access until the end of the period you have paid for.
- We will give you at least 14 days' notice by email before any price rise or any reduction to your plan's allowances. If you signed up before 8 August 2026, you keep the Max plan's allowances free until 8 February 2027 as a founding member (the priority queue excepted), after which your account moves to the plan you are on.
- You can also make a voluntary donation to support development. Donations are optional, unlock nothing, and do not change your access.
- Payments are processed by Stripe. We do not store your card details.
8. Refunds
The Free plan costs nothing, so there is nothing to refund. On a monthly paid plan you can cancel at any time and keep access until the end of the month you have paid for. On an annual plan you can request a full refund within 14 days of the charge. Voluntary donations are gifts to support development and are generally non-refundable, though if you donated by mistake, email us and we'll help. If you are charged for something that is not working as advertised, email edaptlearn@gmail.com and we'll sort it out. The Australian Consumer Law guarantees always apply and aren't excluded by these Terms, including your right to a repair, replacement or refund if a service fails to meet a consumer guarantee.
9. Termination
You can delete your account any time from settings. If your account manages classes with enrolled students, contact us first so we can transfer or close them, we won't delete other students' work automatically. We can suspend or close accounts that breach these Terms or that have been inactive for 24+ months. Deleting your account erases your personal data immediately, except billing records we're legally required to keep.
10. Warranties and disclaimers
Edapt is provided "as is". We don't guarantee that lessons will be error-free, that the service will always be available, or that it will fit any particular exam outcome. Nothing in this section limits the consumer guarantees you have under the Australian Consumer Law.
11. Liability
To the maximum extent permitted by law, Edapt's total liability for any claim arising from your use of the service is limited to the amount you paid Edapt in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages (e.g. exam results).
12. Changes to these terms
We may update these Terms from time to time. The current version is always on this page, and the "Last updated" date above shows when it last changed. Continuing to use Edapt after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes go to the courts of Victoria.
